What did the Supreme Court say?
The Supreme Court said in its recent verdict that no government employee can be branded as corrupt just by being accused of misuse of power unless there is concrete evidence of demanding and accepting a bribe. This verdict is related to Section 20 of the Prevention of Corruption Act, 1988, which believes that if a government official takes undue advantage, it must have been taken with the wrong intention. What was the matter?
In this case, a government official was accused of ignoring government policies and giving fishing contracts without a tender process, causing a loss of crores of rupees to the government. Supreme Court’s decision
A bench of Justices Sudhanshu Dhulia and K Vinod Chandran heard the case in the Supreme Court. They found that there was no concrete evidence of demanding and accepting bribes anywhere in this case. Just saying that the officer misused his powers does not prove that he must have taken a bribe. The Supreme Court also cited the Neeraj Dutta vs State 2022 case, which said that there must be evidence of demanding and accepting bribes. The court clarified that if the investigation report does not prove that the accused has demanded or taken a bribe, then a corruption case cannot be filed against him. The court dismissed the case completely, saying that it is not fair to implicate anyone in corruption charges without concrete evidence.
What will be the impact of this decision?
This decision made it clear that if a government official is to be accused of corruption, then only allegations will not be enough, but solid evidence will also have to be presented for it. Now, just by saying that an official violated the rules, he cannot be held guilty unless it is proved that he has also taken a bribe.
