The Supreme Court gave this decision keeping in mind the irregularities in the recruitment of Class IV employees in 2010 by the Jharkhand High Court. A bench of Justices Pankaj Mithal and Sandeep Mehta upheld the termination of services of candidates selected in the recruitment exam conducted by the Jharkhand High Court in 2010 for Class IV employees as the total number of posts available was not specified in the recruitment process. In this recruitment, information about the total number of posts, and reserved and unreserved seats was not given. The court declared it illegal and cancelled the entire recruitment process.

What information is mandatory?

The court clearly stated in its decision that for any valid government recruitment, it is necessary that the following information is clearly given in the advertisement:

  • Total number of posts available
  • Details of reserved and unreserved seats
  • Minimum Qualifications
  • Selection process – written test, interview etc.
  • Lack of transparency makes recruitment illegal

If a state government does not want to give reservation, then it will also have to clearly mention this decision in the advertisement. Failure to do so will render the entire recruitment process illegal. The Supreme Court has given this decision on the basis of the decision of the 2014 case “Renu vs District and Sessions Judge, Tis Hazari Court, Delhi”.
