Supreme Court Bold Verdict: Move On from a Broken Marriage, Life Awaits

The Supreme Court recently gave its verdict in a similar case and made it clear that the failure of marriage does not mean the end of life. Rather, both the parties should move forward and make a new beginning.

A bench of the Supreme Court, consisting of Justices JB Pardiwala and R Mahadevan, dissolved the marriage of a young couple using special rights under Article 142. The couple had separated within a year of marriage and since then was embroiled in several cases one after the other. The court explained to the two, “If the marriage has failed, it is not the end of life. You should move forward and make a new beginning.”

Husband and wife were embroiled in 17 legal cases

In this case, more than 17 legal cases were going on between the husband and wife and their families in various courts of Maharashtra and Madhya Pradesh. The wife had accused her husband and in-laws of dowry harassment (Section 498A IPC) and domestic violence. At the same time, the husband and his family had also filed cases in protest.

The Supreme Court took the initiative to end this dispute

  • “There is no point in these cases going on for years. This will not give peace to anyone.”
  • The court ended all legal cases
  • Along with dissolving the marriage, the Supreme Court also ended all the cases going on between the two parties. The court said,
  • “If there is any other pending case, then it should also be considered over.”
  • After this decision, both of them will no longer have to get into any legal hassles and they can start a new life.

Right to end a dead marriage

It is worth noting that under Section 13(1) (ia) and 13(1) (ib) of the Hindu Marriage Act, ‘cruelty’ and ‘abandonment’ have been considered as grounds for divorce, but ‘irretrievably broken marriage’ is not considered a ground for divorce. The Supreme Court, in its landmark judgment on May 1, 2023, had said that if a relationship is completely ruined and there is no hope left in it, then the court can end it using its special powers.

Court’s advice move on peacefully

In this entire case, the Supreme Court advised the husband and wife, “Now that the marriage is over, both of them should move forward in their lives peacefully and make a new beginning.” The marriage needs to be successful, but if it breaks down for some reason, it does not mean that life is over. To move forward in life, we must leave the past and look towards tomorrow.
