Recently, the Bombay High Court gave an important verdict, in which it was emphasized that everyone is becoming sensitive towards their caste, but is not fulfilling the responsibility of respecting others.
What was the whole matter?
This case started at the Daulatabad police station in Chhatrapati Sambhajinagar district of Maharashtra. In August 2019, an FIR was registered against a person named Devendra Patil for a social media post. It was alleged that he reprimanded a person for writing against the Brahmin community on social media and during this, he insulted Dr. Bhimrao Ambedkar. Due to this allegation, a case was registered against him under the Indian Penal Code (IPC) and Scheduled Castes and Tribes Atrocities Prevention Act (SC/ST Act).
Court’s view Give respect, take respect
When the court investigated the matter deeply, it found that Patil did not intend to insult Dr Ambedkar. He had only raised the question that when people themselves are not following his principles, then why are they using his name? Also, the court also observed that the person who complained had himself posted inflammatory posts against the Brahmin community on social media. In this decision, the court gave a very important message – if a community is sensitive towards its feelings, then it should also take care of the respect of others.
Freedom of expression and responsibility
The court also said in this case that it is not necessary to react to every social media post or comment. People can disagree on any subject, but it should be done in a civilized and responsible manner. Freedom of expression is given in our Constitution, but this does not mean that we insult anyone or spread hatred against anyone.
It is necessary to move beyond caste discrimination
India is a country full of diversity, where people of different castes, religions and cultures live. But if we remain sensitive only towards our caste or religion and do not care about the respect of others, then the distance in society will increase further. This decision of the court teaches us that we have to adopt the spirit of mutual respect, only then we can build a strong and united society.
Court’s final decision
After considering all these aspects, the Bombay High Court quashed all the criminal cases registered against Devendra Patil. The court said that it is wrong to unnecessarily drag anyone into the legal process, especially when the intention is not to insult. This decision is a lesson not only for this case but for the entire society. We have to understand that along with protecting our feelings, we should also respect the feelings of others. It is not wrong to have disagreement on caste, religion or any other issue, but it is very important to express it in a civilized and responsible manner.
