A “suit” or “litigation” is a legal action or case filed before a court. In a broader sense, a lawsuit means one party registers a claim against another for a legal right. This process is handled by a judicial system, where they file a complaint to protect the claims. If required, they also set a trial to sort out the conflict.

Before proceeding towards the difference between commercial suit and civil suit, we first try to understand what basically both these laws are;

Commercial Litigation

Commercial litigation or legal action involves lawful disputes between businesses regarding contracts, partnerships, intellectual property, or LLC issues. Mostly, the federal court handles these cases. 

Civil Litigation

Civil litigation refers to legal controversy between people. In this case, criminal charges are not implicated. When two homeowners have a dispute regarding their ownership, their case will be categorized as civil litigation. 

Difference Between Civil and Commercial Law

  • The commercial litigation cases are more complicated than the civil litigation cases.
  • Commercial cases are more specific than civil ones.
  • Commercial cases involve large-scale investigations, including forensic tests and research processes. On the other hand, civil cases are easier to solve than commercial cases.

  • Federal courts resolve commercial cases, while state courts resolve civil cases.
  • Commercial litigation involves the business; on the other hand, civil litigation involves individuals.
  • Civil cases are resolved more quickly than commercial litigation, which persists for years.

Regardless of differences, Commercial suits and civil suits also have some similarities that are given below;

Similarities Between Commercial Suit and Civil Suit

  • Both accusers and litigants hire attorneys for their cases. 
  • Both parties are involved in the investigation process to collect facts. 
  • Attorneys research the relevant laws and engage in a decision agreement. The attorney on the accuser’s side files the legal action.
  • Both parties are involved in discovery and participate in requesting relief from the court. 
  • They present their cases to a judge or jury or can sort out the dispute outside. 
  • After the trial, they may file motions or other necessary actions regarding their case.

Everything is changing, whether political administrations, laws, rules, and regulations, court sessions, the economy, or business land. Most business legal proceedings are either set to change or have already experienced modifications.

According to the yearly case statistics, the number of legal cases and dispute resolution time are increasing. The recent federal court report shows an 8% increase in civil cases and a 7% increase in federal cases. The same data also shows that the average time from filing to resolution for civil cases was 9.2 months, 8.8 months more than in previous years. 

Moreover, the number of companies facing “bet-the-company” cases has increased fourfold in the past two years. Businesses are increasingly looking for a quick agreement. Additionally, companies are spending more on employment, intellectual property, and class action legal proceedings due to the higher risks of such cases.
