For thousands of homebuyers who have waited endlessly for the keys to their dream homes, April 29, 2025, came as a day of renewed hope. The Supreme Court of India has stepped in decisively, ordering a full-fledged CBI investigation into what it described as an “unholy nexus” between real estate developers and financial institutions.

When Dreams Turned into Financial Nightmares

The core of this legal storm lies in the stories of more than 1,200 homebuyers who were promised possession of their flats years ago. Most of these projects, launched between 2013 and 2015 in Delhi-NCR and other metro cities, have remained incomplete. Yet, the buyers were forced to continue paying EMIS because banks had already disbursed massive portions of the loan amounts, up to 70 per cent, under subvention schemes.

Among the names facing the heat is Supertech, a well-known real estate brand in India. With over 21 ongoing projects across six cities, the company has come under intense scrutiny for delays and possible financial irregularities. The Supreme Court has now ordered that Supertech’s transactions with eight banks be investigated on a priority basis. In total, dealings with 19 financial institutions are being examined to determine the extent of the collusion.

Supreme Court Steps in with Strong Words and Stronger Action

The Supreme Court bench, comprising Justice Surya Kant and Justice N Kotiswar Singh, made it clear that this isn’t just about unfinished homes, it’s about a systemic failure where authorities did not perform their duties. The Court highlighted how hundreds of families were left helpless as construction stopped, promises were broken, and banks began taking coercive steps when EMIs were delayed.

In a landmark move, the Supreme Court has directed the Central Bureau of Investigation (CBI) to register seven preliminary inquiries and form a Special Investigation Team (SIT) to supervise them. Additionally, the police departments of Uttar Pradesh and Haryana have been asked to provide all necessary support for a smooth and impartial investigation.

This decision by the Supreme Court is not just a legal directive, it is a moral statement. It acknowledges the pain and anxiety faced by homebuyers who placed their trust in builders and banks alike. Many of them had dreamed of living in their own homes by now, only to find themselves trapped in a cycle of debt and uncertainty.

It has also instructed the CBI to submit an interim report on its findings as soon as possible.
