This case is of a man named Vimal Ranjit Biswas, who was arrested by the police on 9 January 2024 from an industrial area in Bhayander. Investigation revealed that he was living in India without valid documents and was working here illegally. During interrogation, he admitted that he had entered India by paying Rs 20,000 to an agent. However, he did not have any valid documents that could prove that he was entitled to stay in India.

Strict stand of the court

Additional Sessions Judge G. T. Pawar clearly said during the hearing in this case that under Section 9 of the Foreigners Act, it is the responsibility of the accused to prove that he is living in India legally. The court said in its order, “Neither during the investigation nor during the hearing did the accused present any document that proves that he is an Indian citizen or has entered India legally.”

What was the punishment?

The Maharashtra Court sentenced Vimal Ranjit Biswas to one year and 54 days, but since he had already spent that much time in jail, he was released.
