What did the Supreme Court say?

When the matter reached the Supreme Court, a bench of Justice Abhay S Oka and Justice Ujjwal Bhuyan strongly reprimanded the Chhattisgarh Police. He said that this is “not just an attempt to arrest the accused, but a wrong way to evade the judicial order.” The court further said, “If the police misuse the law in this way, it will weaken the judicial process. This step of the police is completely improper and motivated by wrong intention.” The court even said that if the police officers ignore the orders in this way, then a case of contempt of court can also be filed against them.

State government’s argument and court’s response

It was argued on behalf of the Chhattisgarh government that Manish Rathod has a criminal record and has been involved in Naxalite activities. The government also said that he had violated the conditions of bail earlier as well. But the Supreme Court rejected this argument of the state government and said “When we had already given interim protection, then making such an arrest after that is an insult to justice.”
