This decision was given by the bench of Justice J.B. Pardiwala and R. Mahadevan. The court clearly said that disabled persons should also get equal opportunity in judicial service and the government should give them all possible assistance so that they can also play their role in judicial service.

Relief for Divyang candidates

After this decision, all those Divyang candidates who appeared in the judicial service examination can now get their candidature considered. If they meet other qualifications, they can get an appointment. The Supreme Court said that any rule that excludes the disabled from judicial service is unconstitutional and should be removed. The fight started with a letter written to the former Chief Justice. The case started when the mother of a blind candidate wrote a letter to former Chief Justice D.Y. Chandrachud. In this letter, she said that her son was excluded from judicial service only due to his disability. After this, the Supreme Court took cognizance of the matter and turned it into a petition under Article 32 of the Constitution.

Victory of rights of the disabled

The basis of this decision was the Rights of Persons with Disabilities Act, 2016, which states that disabled persons cannot be excluded from any service only due to their physical reasons. The court also said that the state governments will have to make special arrangements for disabled persons, such as exemption in examination, special training and a favourable environment for them.

Now, after this decision, the participation of Divyang candidates in the judicial service will increase. Along with this, similar rules will be reconsidered in other states as well, so that Divyang persons can get equal opportunity in the judiciary.
