The Supreme Court has given a historic verdict, which will give more equal opportunities to the candidates of the Divyang (Persons with Disabilities – PwD) category in the Judicial Service Examination. The court has given clear instructions that a separate cut-off should be fixed for the PwD category in the Rajasthan Judicial Service Examination and a separate merit list should be prepared at every stage.
Why was this decision necessary?
Till now, separate cut-offs were fixed for women, divorced and widow candidates in the Rajasthan Judicial Service Examination, but there was no clear cut-off for the PwD category. This meant that Divyang candidates had to compete with the rest of the general categories, making the selection process more difficult for them. The Supreme Court bench of Justices JB Pardiwala and R. Mahadevan said that when the law has created a separate category for PwD candidates, then separate cut-offs and merit lists should also be mandatory for them. Without declaring the cut-off, there is a lack of transparency and candidates do not know what is the basis of the selection process.
Divyang candidates will get justice
The court also said that if a separate cut-off is not fixed for PwD candidates, they will not be able to compete at the same level. This would be a violation of their rights and would violate the RPwD Act, 2016, which ensures reservation and equal opportunity in employment for persons with disabilities. In addition, the court also clarified that no legal discrimination can be made between PwD and PwBD (Persons with Benchmark Disabilities). Any kind of discrimination on technical grounds would be legally wrong.
Disabled candidates can get a chance at judicial services
This decision has brought relief to thousands of disabled candidates who are preparing for the judicial service examination. Now they will be able to know how much cut-off has been set separately for them and how the merit list has been prepared. This will bring transparency in the examination process and disabled candidates will get equal opportunity.
This decision of the Supreme Court is a big step for the disabled candidates, which will protect their rights and provide them equal opportunity to advance in judicial services. This will not be limited to Rajasthan Judicial Service Exam only but will set a new precedent for judicial service examinations across the country.
