In 2006, when their colleagues got the benefit of permanent jobs, they too knocked on the doors of the court in the hope of justice. The High Court gave a decision in their favour in 2007, but the government did not implement this order for 16 years.

The Supreme Court bench, which included Justice Surya Kant and Justice N. Kotiswar Singh, said that the government not only delayed the implementation of the order but also harassed the workers repeatedly. The court also said that strict action should be taken against the guilty officials and they can also be fined. However, the court has not given any punitive order yet, as the matter is currently pending before a single judge of the Jammu and Kashmir High Court. However, the Supreme Court requested the High Court to hear the case on a weekly basis so that the workers could get their rights as soon as possible.

The government’s negligence troubled the workers

This case started when in 2006 some daily wage workers filed a petition in the court to make their jobs permanent. The court ruled in their favour and ordered them to be made permanent under SRO 64 of 1994. But the government ignored this order, due to which the workers had to approach the court once again. In 2010, the workers filed a contempt petition against the government, but the case remained pending for 14 years. In 2014, the High Court rejected the government’s objections, but even then no action was taken. When the government challenged the High Court order, the court rejected their appeal and also imposed a fine of Rs 25,000. Now the Supreme Court has taken a tough stand on this whole matter.
