How long to wait for appointment?
The process of West Bengal Judicial Service Examination 2022 started with the preliminary examination in March 2023. After this, the main examination was conducted in May 2023 and then the interviews were conducted in April 2024. After the completion of all the process, the final merit list was also released in May 2024. Despite this, the selected candidates have not received the appointment letter till now.
Ignoring the order of the Supreme Court
The Supreme Court had clearly stated in the judgment of Malik Mazhar Sultan vs UP Public Service Commission (2008) that the entire process of judicial service examination should be completed within a year. But this is being violated openly in West Bengal.
Increasing burden on the judiciary
Not a single new civil judge has been appointed for the last three years. This has increased the burden of cases in the district courts of the state. According to government data, as of July 15, 2023, there were 6,22,950 civil cases and 22,80,565 criminal cases pending in West Bengal. These figures clearly show how much pressure is being put on the judicial system.
Why is the appointment stuck?
An interim order of the High Court has put the appointments on hold. This order, issued on September 19, 2024, was extended from time to time and was last extended on December 16, 2024. Although the hearing of this case was completed in December 2024, the final decision has not come till now. Due to this, the future of all the selected candidates is hanging in the balance.
Candidates’ concern and government apathy
In March 2024, Calcutta High Court Chief Justice T. S. Sivagnanam had also expressed concern over this delay. He had said that the candidates are under mental stress due to the continuous delay and their hard work seems to be going in vain. The most shocking thing is that no new judicial officer has been appointed after the 2021 batch. The appointment of the candidates of the 2022 batch is on hold and the examinations for 2023 and 2024 have not even been announced. If this situation remains, then the judicial recruitment process of West Bengal may come to a complete halt.
Will justice be given?
The only demand of the candidates who have passed the examination is that the appointment process should be completed as soon as possible, so that they can contribute to getting justice to the public along with their rights. This delay is not only affecting their career, but is also having a huge impact on the judiciary.
