The matter started when 17 students were suspended by the university administration. These students had held a peaceful demonstration within the campus, in which they were remembering the day when the police entered the university and allegedly used force. The students said that they were only expressing their opinion and their demonstration was completely peaceful. However, the university administration considered it indiscipline and suspended them without a hearing.

High Court’s intervention and big decision

When the students challenged this decision in court, the Delhi High Court stayed their suspension sentence. The court headed by Justice Dinesh Kumar Sharma not only expressed concern over this strict action but also directed the university to form a committee to resolve this dispute. This committee will be overseen by the Vice Chancellor himself and will also include representatives of the students.

There is nothing wrong with peaceful protest

The court questioned the attitude of the university in this entire matter and said that the students have the right to raise their voices, provided it is peaceful. The court also said that – “When students come to the university, they try to put forward their point within the ambit of the law. Participating in such peaceful protests is also a part of the training to understand the basic principles of civil society.”

 

Senior lawyer’s argument in favour of students

Senior lawyer Colin Gonsalves argued on behalf of the students that this action was completely unfair and unconstitutional. He said that the students were not even given a chance to present their side and the university administration took a hasty decision. At the same time, lawyer Amit Sahni argued on behalf of the university that the students were given ample opportunity and that this demonstration was not related to academic activities. Also, no prior permission was taken for the demonstration.

The court hoped that the university administration would handle the situation in a better way and establish a dialogue with the students. The court also said that the Vice Chancellor, Dean and Chief Proctor should take such steps, which will normalize the situation and the future of the students will not be affected. This decision is a victory for freedom of expression and the democratic values ​​of the students. It shows that peaceful demonstration is not a crime, but it is an important part of democracy.
