They emphasized that the deceased was in continuous emotional distress, even after leaving her marital home, and highlighted a long phone call between the accused and the woman just four days before her death. They also stressed that the accused had filed for judicial separation, which added further emotional strain.

Court’s Observations Justice Beyond Technicalities

Justice Girish Kathpalia, who heard the case, made some profoundly significant observations. The Court clearly stated that dowry deaths cannot be judged solely on technical grounds such as the location of death. What matters, the Court said, is the existence of a marital relationship and the continuity of emotional and psychological abuse, which often pushes victims to the edge. Referring to landmark Supreme Court rulings, the Judge emphasized that the law must be interpreted in a way that upholds its true purpose to protect vulnerable women from abuse and ensure justice for those who lose their lives because of it. The idea of “soon before death” doesn’t mean the harassment had to occur just a few hours or days prior. It speaks of a pattern, a persistent environment of abuse, which ultimately leads to tragedy.
