Why did this matter reach the court?

Akash Goyal, a citizen of Delhi, filed a Public Interest Litigation (PIL) in the High Court raising the issue that there is no proper law and order for marriage registration in Delhi. He termed the Delhi (Compulsory Marriage Registration) Order implemented in 2014 as constitutionally wrong and said that it is not by the 2006 instructions of the Supreme Court.

The court also expressed concern over this and said that the existing registration system is not only disorganized but also violates the instructions of the Supreme Court. The court also admitted that without any concrete law, it is not possible to make marriage registration mandatory only based on government orders.

Are women’s rights being violated?

A very important issue was raised in this petition that women suffer the most due to lack of marriage registration. Under Articles 14 and 21 of the Constitution, women have the right to live with equality and dignity, but when the process of marriage registration is so difficult that people start avoiding it, then the rights of women are directly affected.

What did the High Court say?

The bench of Chief Justice Devendra Kumar Upadhyay and Justice Tushar Rao Gedela of the Delhi High Court took this matter seriously and sought a reply from the Center and the Delhi Government within three months. The court said that citizens should not approach the court for such basic services, rather the government should make this process easier. The court also said that no national-level database has been created so far for marriage registration, which is very important. Also, the court asked the government why the facility of online applications is not being provided using digital technology.

When will the next hearing be held?

This matter is not over yet. The Delhi High Court has fixed July 9 as the date for the next hearing on this. Now it remains to be seen what steps the government takes on this issue and whether a permanent solution to this problem is found by making a new law or not.
