Following this order, the court also ordered Defendant No. 3 to file an affidavit of the number of packages manufactured by February 4, 2025. This affidavit will ensure that only old packaged products will come out in the market. The court also said that a settlement can be considered in this matter.

The court also made it clear during this time that it would try to take the matter towards a peaceful resolution so that a balanced solution could be found for both parties.

This matter was first raised when a company alleged that Defendant No. 3 had copied its trade dress, causing confusion among customers. The plaintiffs had alleged trademark infringement, copyright infringement and “passing off”.
